several<\/span><span data-offset-key=\"6i6qo-58-0\"> times<\/span><span data-offset-key=\"6i6qo-59-0\"> since<\/span><span data-offset-key=\"6i6qo-60-0\"> then<\/span><span data-offset-key=\"6i6qo-61-0\">.<\/span><span data-offset-key=\"6i6qo-62-0\"> The<\/span><span data-offset-key=\"6i6qo-63-0\"> most<\/span><span data-offset-key=\"6i6qo-64-0\"> recent<\/span><span data-offset-key=\"6i6qo-65-0\"> amendment<\/span><span data-offset-key=\"6i6qo-66-0\">,<\/span><span data-offset-key=\"6i6qo-67-0\"> known<\/span><span data-offset-key=\"6i6qo-68-0\"> as<\/span><span data-offset-key=\"6i6qo-69-0\"> the<\/span><span data-offset-key=\"6i6qo-70-0\"> Copyright<\/span><span data-offset-key=\"6i6qo-71-0\"> in<\/span><span data-offset-key=\"6i6qo-72-0\"> the<\/span><span data-offset-key=\"6i6qo-73-0\"> Digital<\/span><span data-offset-key=\"6i6qo-74-0\"> Single<\/span><span data-offset-key=\"6i6qo-75-0\"> Market<\/span><span data-offset-key=\"6i6qo-76-0\"> Directive<\/span><span data-offset-key=\"6i6qo-77-0\">,<\/span><span data-offset-key=\"6i6qo-78-0\"> was<\/span><span data-offset-key=\"6i6qo-79-0\"> adopted<\/span><span data-offset-key=\"6i6qo-80-0\"> in<\/span><span data-offset-key=\"6i6qo-81-0\"> 2019<\/span><span data-offset-key=\"6i6qo-82-0\">.<\/span> <span data-offset-key=\"6i6qo-85-0\">The<\/span><span data-offset-key=\"6i6qo-86-0\"> directive<\/span><span data-offset-key=\"6i6qo-87-0\"> sets<\/span><span data-offset-key=\"6i6qo-88-0\"> out<\/span><span data-offset-key=\"6i6qo-89-0\"> various<\/span><span data-offset-key=\"6i6qo-90-0\"> rights<\/span><span data-offset-key=\"6i6qo-91-0\"> that<\/span><span data-offset-key=\"6i6qo-92-0\"> copyright<\/span><span data-offset-key=\"6i6qo-122-0\"> form<\/span><span data-offset-key=\"6i6qo-123-0\"> of<\/span><span data-offset-key=\"6i6qo-124-0\"> exploitation<\/span><span data-offset-key=\"6i6qo-125-0\"> of<\/span><span data-offset-key=\"6i6qo-126-0\"> their<\/span><span data-offset-key=\"6i6qo-127-0\"> work<\/span><span data-offset-key=\"6i6qo-128-0\">.<\/span><span data-offset-key=\"6i6qo-129-0\"> data-offset-key=\"6i6qo-150-0\">.<\/span> <span data-offset-key=\"6i6qo-153-0\">The<\/span><span data-offset-key=\"6i6qo-154-0\"> directive<\/span><span data-offset-key=\"6i6qo-155-0\"> has<\/span><span data-offset-key=\"6i6qo-156-0\"> been<\/span><span data-offset-key=\"6i6qo-157-0\"> controversial<\/span><span data-offset-key=\"6i6qo-158-0\"> since<\/span><span data-offset-key=\"6i6qo-159-0\"> its<\/span><span data-offset-key=\"6i6qo-160-0\"> inception<\/span><span data-offset-key=\"6i6qo-161-0\">,<\/span><span data-offset-key=\"6i6qo-162-0\"> with<\/span><span data-offset-key=\"6i6qo-163-0\"> some<\/span><span data-offset-key=\"6i6qo-164-0\"> arguing<\/span><span data-offset-key=\"6i6qo-165-0\"> that<\/span><span data-offset-key=\"6i6qo-166-0\"> it<\/span><span data-offset-key=\"6i6qo-167-0\"> goes<\/span><span data-offset-key=\"6i6qo-168-0\"> too<\/span><span data-offset-key=\"6i6qo-169-0\"> far<\/span><span that<\/span><span data-offset-key=\"6i6qo-181-0\"> it<\/span><span data-offset-key=\"6i6qo-182-0\"> doesn<\/span><span data-offset-key=\"6i6qo-183-0\">\u2019<\/span><span further<\/span><span data-offset-key=\"6i6qo-196-0\"> stoked<\/span><span data-offset-key=\"6i6qo-197-0\"> these<\/span><span data-offset-key=\"6i6qo-198-0\"> debates<\/span><span data-offset-key=\"6i6qo-199-0\">.<\/span> <span data-offset-key=\"6i6qo-202-0\">Critics<\/span><span data-offset-key=\"6i6qo-203-0\"> of<\/span><span data-offset-key=\"6i6qo-204-0\"> the<\/span><span data-offset-key=\"6i6qo-205-0\"> directive<\/span><span data-offset-key=\"6i6qo-206-0\"> argue<\/span><span data-offset-key=\"6i6qo-207-0\"> that<\/span><span data-offset-key=\"6i6qo-208-0\"> it<\/span><span data-offset-key=\"6i6qo-209-0\"> will<\/span><span data-offset-key=\"6i6qo-210-0\"> st<\/span><span data-offset-key=\"6i6qo-211-0\">ifle<\/span><span data-offset-key=\"6i6qo-212-0\"> data-offset-key=\"6i6qo-216-0\"> making<\/span><span data-offset-key=\"6i6qo-217-0\"> it<\/span><span data-offset-key=\"6i6qo-218-0\"> harder<\/span><span data-offset-key=\"6i6qo-219-0\"> for<\/span><span data-offset-key=\"6i6qo-220-0\"> people<\/span><span data-offset-key=\"6i6qo-221-0\"> to<\/span><span data-offset-key=\"6i6qo-222-0\"> use<\/span><span data-offset-key=\"6i6qo-223-0\"> existing<\/span><span data-offset-key=\"6i6qo-224-0\"> copyrighted<\/span><span data-offset-key=\"6i6qo-225-0\"> material<\/span><span data-offset-key=\"6i6qo-226-0\"> in<\/span><span data-offset-key=\"6i6qo-227-0\"> new<\/span><span data-offset-key=\"6i6qo-228-0\"> ways<\/span><span data-offset-key=\"6i6qo-229-0\">.<\/span><span data-offset-key=\"6i6qo-230-0\"> A number of criticisms have been levelled at the Copyright Directive. These include the criticisms that it will:<\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #666699;\">severely undermine the free expression of Internet users who risk having user-generated content they attempt to post blocked from publication by companies wary of running afoul of new copyright laws;<\/span><\/li>\n<li><span style=\"color: #666699;\">Add to the regulatory confusion on what is lawful and what is not. The Directive is not itself law but a framework that forms the basis on which Member States need to draft their own laws;<\/span><\/li>\n<li><span style=\"color: #666699;\">force online services to install automated copyright filters that will over-block legitimate material, including memes and remixes by virtue of the much-maligned Article 13. The SaveYourInternet campaign has claimed that Article 13 &#8220;would turn the whole internet into a copyright police&#8221; and &#8220;make platforms responsible for enforcing copyright instead of rights-holders&#8221;;<\/span><\/li>\n<li><span style=\"color: #666699;\">threaten hyper links through the &#8220;link tax&#8221; emanating from Article 11, when hyperlinks are an essential tool for news sites to communicate with their readers. Article 11 is designed to protect news publishers by preventing aggregators from using snippets of online content without paying a licensing fee. However, critics say it will force companies like Google to pay for links that it has used for free for years. The move would also make it harder for new entrants to compete with established platforms. The SaveYourInternet campaign has claimed that Article 11 will &#8220;destroy the Internet as we know it and lead to a more fragmented, less diverse online world.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Critics <span data-offset-key=\"8hsm4-35-0\">have warned that if the legislation goes ahead, it will encourage repressive regimes like China and Russia to demand similar laws in an attempt to control content on their own national versions of Facebook and Google. Moreover, they have claimed that the<\/span><span data-offset-key=\"nii7-69-0\"> Directive<\/span><span data-offset-key=\"nii7-70-0\"> will<\/span><span data-offset-key=\"nii7-71-0\"> not<\/span><span data-offset-key=\"nii7-72-0\"> harmon<\/span><span data-offset-key=\"nii7-73-0\">ise<\/span><span data-offset-key=\"nii7-74-0\"> copyright<\/span><span data-offset-key=\"nii7-75-0\"> laws<\/span><span data-offset-key=\"nii7-76-0\"> across<\/span><span data-offset-key=\"nii7-77-0\"> Europe<\/span><span data-offset-key=\"nii7-78-0\"> because<\/span><span data-offset-key=\"nii7-79-0\"> it<\/span><span data-offset-key=\"nii7-80-0\"> does<\/span><span data-offset-key=\"nii7-81-0\"> not<\/span><span data-offset-key=\"nii7-82-0\"> provide<\/span><span data-offset-key=\"nii7-83-0\"> for<\/span><span data-offset-key=\"nii7-84-0\"> harmon<\/span><span data-offset-key=\"nii7-85-0\">isation<\/span><span data-offset-key=\"nii7-86-0\">.<\/span><span data-offset-key=\"nii7-87-0\"> It<\/span><span data-offset-key=\"nii7-88-0\"> creates<\/span><span data-offset-key=\"nii7-89-0\"> loopholes<\/span><span data-offset-key=\"nii7-90-0\"> and<\/span><span data-offset-key=\"nii7-91-0\"> exceptions<\/span><span data-offset-key=\"nii7-92-0\"> that<\/span><span data-offset-key=\"nii7-93-0\"> will<\/span><span data-offset-key=\"nii7-94-0\"> be<\/span><span data-offset-key=\"nii7-95-0\"> exploited<\/span><span data-offset-key=\"nii7-96-0\"> by<\/span><span data-offset-key=\"nii7-97-0\"> those<\/span><span data-offset-key=\"nii7-98-0\"> with<\/span><span data-offset-key=\"nii7-99-0\"> vested<\/span><span data-offset-key=\"nii7-100-0\"> interests<\/span><span data-offset-key=\"nii7-101-0\">.<\/span><span data-offset-key=\"nii7-102-0\"> Critics have in fact elicited the so-called<\/span><span data-offset-key=\"nii7-106-0\"> \u201c<\/span><span data-offset-key=\"nii7-108-0\">trans<\/span><span data-offset-key=\"nii7-109-0\">port<\/span><span data-offset-key=\"nii7-110-0\"> of<\/span><span data-offset-key=\"nii7-111-0\"> goods<\/span><span data-offset-key=\"nii7-112-0\">\u201d<\/span><span data-offset-key=\"nii7-113-0\"> loophole<\/span><span data-offset-key=\"nii7-114-0\">. In this way, the \u201cbig guys\u201d will stifle innovation and free speech \u2013 exactly what the Directive claims they are trying to prevent. This, they say, is exactly what has happened in various countries around the world when similar or identical laws were introduced. <\/span><\/p>\n<p style=\"text-align: justify;\">The<span data-offset-key=\"nii7-253-0\"> Directive also introduces new restrictions on research and education, and it allows for all kinds of new restrictions on freedom of speech, such as an obligation for Internet service providers to monitor their users\u2019 online activities and remove any illegal content (which they may not even know about). <\/span><\/p>\n<p style=\"text-align: justify;\">While the final form that national-level copyright law in the EU will take under the Copyright Directive is still a work in progress in most EU Member States, the obligations of the Copyright Directive will invariably cajole companies into taking far more invasive steps than has ever been the case in the past to endeavour to identify and filter out copyrighted user-generated content. When these companies automate their decision-making process and have to draw the line on errors that such systems may make from time to time, they will inevitably choose to err on the side of caution. The inevitable upshot is that Internet users will experience more obstacles in posting and accessing online content than has ever been the case hitherto.<\/p>\n<p>[\/vc_column_text]<div
